We represent intended parents or donors in all types of egg donation, sperm donation, and embryo donation arrangements: independent or agency-matched; IVF or insemination; between friends, family members, or non-identified/anonymous. In all circumstances, a legal agreement should be in place to protect the rights and expectations of the parties. We guide our clients with a focus on aligning expectations, full understanding of all terms, and efficiency.

Considerations:

  1. What would be done with remaining embryos after all treatment cycles have been completed?

    • Options include: discard, donation for medical research, and donation to another person/couple for the purpose of conception

    • For embryo donation: would remaining embryos be “returned” back to the donors?

  2. Will the parties maintain future contact to exchange relevant medical information? Will the donor be asked to register with the Donor Sibling Registry for future communication?

  3. Have all parties completed psychological interviews?

  4. Will the donor be informed of a resulting birth?

  5. Is the donor open to direct contact with the child in the future upon request?

    • For embryo donation: will biological siblings have the possibility of direct contact?
